1. Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:

• “Company”(referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to The Boros Collection, a trading name of The Luxury Collection Real Estate Brokers LLC.
• “Country” refers to the United Arab Emirates.
• “Content” refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
• “Device” means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• “Enquiry” means a request You submit through the Service to receive information about a property, arrange a viewing, request a valuation, or otherwise be contacted by the Company.
• “Feedback” means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
• “Listings” means information about properties for sale, for rent, or off-plan, published on the Service.
• “Service” refers to the Website.
• “Terms and Conditions” (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

• “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service. You represent that you are over the age of 18. Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy, which describes how we collect, use and disclose your personal information.

3. Property Listings & Information

Property details published on the Service, including descriptions, specifications, availability, images and prices, are provided for general guidance only. This information is sourced from our internal systems and from third parties (including developers, landlords, sellers and property managers) and may change, become out of date, or be withdrawn without notice.

Nothing on the Service constitutes a legal offer, contract, or guarantee of availability. Any sale, purchase, lease, or other transaction is subject to a separate, signed agreement between the relevant parties and to applicable Dubai Land Department and RERA regulations. We recommend confirming current details with your advisor before making any decision.

4. Enquiries

When You submit an enquiry, viewing request, valuation request, or newsletter sign-up through the Service, You agree to provide accurate, current and complete information. By submitting an enquiry, You consent to being contacted by a member of our team by phone, email or WhatsApp in relation to that enquiry.

5. Content You Submit

Where the Service allows You to submit Content (for example, via an enquiry or contact form), You are responsible for the accuracy, legality and appropriateness of that Content. You must not submit any Content that is unlawful, offensive, threatening, defamatory, obscene, infringes the rights of any third party, or is otherwise objectionable, including:

• Unlawful or promoting unlawful activity.
• Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
• Spam, machine- or randomly-generated, constituting unauthorized or unsolicited advertising, chain letters, or any other form of unauthorized solicitation.
• Content containing viruses, worms, malware, trojan horses, or other content designed to disrupt, damage or limit the functioning of any software or hardware.
• Impersonating any person or entity, including the Company and its employees.
• False information or features.

We reserve the right, but not the obligation, to determine whether any Content is appropriate, and to refuse or remove it at our sole discretion.

6. Intellectual Property

The Service and its original content (excluding Content provided by You), features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries. Our trademarks and trade dress, including the Boros Collection name and logo, may not be used in connection with any product or service without our prior written consent.

7. Your Feedback to Us

You assign to the Company all rights, title and interest in any Feedback You provide. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, distribute, modify and exploit such Feedback without restriction.

8. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party websites You visit.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the entire liability of the Company and its suppliers under these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to AED 500, unless You have entered into a separate, signed agreement with the Company for a specific transaction, in which case the terms of that agreement will apply.

In no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever, including but not limited to damages for loss of profits, loss of data, or business interruption, arising out of or in any way related to the use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.

10. “As Is” and “As Available” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE”, without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, and makes no representation that the Service will be uninterrupted, error-free, or that any information on the Service (including Listings) is accurate, complete or current.

11. Governing Law

The laws of the United Arab Emirates, as applied in the Emirate of Dubai, shall govern these Terms and Your use of the Service, without regard to its conflict of law provisions.

12. Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

13. Severability and Waiver

Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver:Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

14. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use the Service after those revisions become effective, You agree to be bound by the revised terms.
